Terms of Service

These Terms of Service ("Terms") govern your use of the Still Here website at stillherehq.com and the Still Here mobile application, operated by Sahaj Tech LLC ("we," "us," or "our"). By using the Service, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 18 years old and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Still Here is a daily check-in application designed for people who live alone. The Service sends you daily check-in reminders and, if you do not respond within a configurable grace period, escalates notifications to you via SMS, to your designated emergency contacts, and ultimately to emergency services via a pre-recorded voice call.
3. Account Responsibilities
You are responsible for:
- Providing accurate and complete information when creating your account.
- Keeping your password secure and not sharing it with anyone.
- Keeping your emergency contact information up to date.
- Ensuring your emergency contacts have consented to being contacted (see our Consent Policy).
- All activity that occurs under your account.
4. Emergency Contact Consent
Before adding someone as an emergency contact, you must obtain their explicit consent. You represent that each emergency contact you add has agreed to receive SMS messages and phone calls from us in the event you fail to check in. We may periodically remind you to verify your contacts' consent. See our Consent Policy for full details.
5. Escalation to Emergency Services
If you enable the emergency services escalation step, a pre-recorded voice call will be placed to 911 on your behalf if all prior escalation steps are exhausted. You acknowledge that:
- This feature places real phone calls to emergency services and should be used responsibly.
- False escalations to 911 may result in real-world consequences and waste of emergency resources.
- You are solely responsible for configuring appropriate grace periods and escalation delays to minimize false alarms.
- We are not liable for any consequences arising from emergency services calls initiated by the Service.
6. Not a Medical or Safety Device
Still Here is a consumer software application and is not a medical device, personal emergency response system (PERS), or substitute for professional monitoring services. The Service relies on your mobile device having power, internet connectivity, and functioning notification delivery. We do not guarantee that escalation notifications will be delivered in any specific timeframe or at all.
7. Limitation of Liability
To the fullest extent permitted by law, Sahaj Tech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:
- Failure of check-in notifications to reach you.
- Failure of escalation notifications to reach your emergency contacts.
- Actions taken or not taken by emergency contacts or emergency services.
- Any personal injury, death, or property damage.
- Any false alarms or unnecessary emergency service dispatch.
8. User Conduct
You agree not to:
- Use the Service for any unlawful purpose.
- Provide false or misleading information in your account or emergency contacts.
- Add emergency contacts who have not consented to being contacted.
- Attempt to interfere with or disrupt the Service's operation.
- Reverse engineer, decompile, or disassemble the Service.
9. Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the app settings. Upon deletion, we will remove your personal information as described in our Privacy Policy.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice within the Service. Your continued use after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Centre County, Pennsylvania.
